I. How We Collect and Use Your Personal Information

We collect your information in three ways: information that you provide, automatically collect, and information from other sources.

1.1 Information You Provide

Account Registration and Login Information . Where you choose to register for or log in to StardustTV using your email address in supported regions, we may collect your email address and related verification information for the purposes of account registration, identity verification, login authentication, account security, and compliance with applicable laws and regulations.

Clipboard Usage . When you share or receive shared information, participate in activities, view promotional content for other products or services, and in other similar scenarios, we need to access your clipboard to write or read share codes, and links contained therein, in order to implement functions or services such as page redirection, sharing, and activity linkage. We will only READ share codes and links from your clipboard for the sole purposes of PAGE REDIRECTION, SHARING, and ACTIVITY LINKAGE, and we will NOT collect, store or transmit any other content from your clipboard to our servers. We only access your clipboard when you actively trigger the relevant functions (e.g., clicking a share button, pasting a referral link), and we do not access your clipboard in the background. You may refuse our access to the clipboard through your device system settings at any time, which will not affect your use of basic service functions such as video browsing and playback.

SPECIAL NOTE: Some mobile and other terminal operating systems may display notifications that an app is reading your clipboard. However, such system notifications cannot distinguish whether clipboard information is actually being collected, and false alerts cannot be ruled out. Therefore, if you encounter similar notifications, please contact us so that we can identify and resolve the issue.

Information You Provide When Contacting Us.  To access customer service on StardustTV, you may provide us with your contact (e.g., email address, phone number etc. ), and text/picture/video information relating to your request. Your UID and relevant problem description are needed to better resolve your problem.We may also collect information in correspondence you send to us, including when you contact us for complaints, support, or feedback.

1.2 Automatically Collected Information

When you access and use StardustTV, we will automatically collect your information:

Device Information.  Information about the device used to access the application, such as the device ID  or other unique identifiers, device and software characteristics (such as type and configuration), system language, referring URL, IP address (only accurate to the city level, without positioning to the specific address), browser information, and standard web server log data; Identifier for Advertising ("IDFA", iOS devices only), so as to ensure the basic availability and stable operation of the Services and ensure the data processing action complies with the relevant regulations of the region where the channel is located. If you refuse to authorize, we will not collect IDFA, nor will it affect the use of the basic functions of the application (such as browsing and playing short plays).

SPECIAL NOTE: Precise geographic location information obtained through GPS data, WLAN access points, Bluetooth, cellular base stations, and other sources will ONLY be collected after you enable location permissions. We will use your precise location information to provide you with more accurate services based on your authorization.

Search/Log Information. When you use our services or view content we provide, we automatically collect and store certain information in our server logs. For example, the date and time of access, the pages or screens viewed (such as v_id, e_id, watch_time) and actions taken within the application. This information helps us understand how users interact with our application and identify any issues or errors. When you use the search service of StardustTV, we will collect your search keywords and log records. To provide efficient search services, part of the aforementioned information will be temporarily stored on your local device, and may be used to display search results and your search history to you.

Local storage.  We may collect and store information, including your personal information locally on your device using mechanisms such as application data caches. This is to speed up the application's loading and short-play playback speed, optimize user experience, and reduce repeated data transmission. You can clear the cache at any time to exercise your right to control your personal information.

Purchase and Payment Information. If you purchase products or services from the Services, we and/or our third-party payment processors may collect your purchase and/or payment information, such as order numbers, payment amounts, payment times, payment statuses, payment channel identifiers, transaction serial numbers, subscription periods, renewal statuses, and deduction times. We process such information solely for the purpose of performing payment transactions, verifying the validity of orders, handling refunds and after-sales services, conducting reconciliation and settlement, and other payment functions necessary for the provision of in-app services or product purchases. If we intend to use such data for non-payment-related purposes in the future, including but not limited to marketing or data analytics , we will obtain your separate and express consent in advance.

Use of Cookies and Similar Technologies. Cookies and device identifiers (such as Android ID, OAID, GAID on Android; IDFV, IDFA on iOS; different identifiers vary in validity period, user-resettability and acquisition methods) and other similar technologies are widely adopted across the Internet. When you use StardustTV and our related services, we may send one or more Cookies or anonymous identifiers to your device using relevant technologies to collect and record information about your access to and use of the Services. Where required by law, we will obtain your consent before using cookies. We undertake not to use Cookies for any purposes other than those stated in this Privacy Policy. We mainly use Cookies and similar technologies to provide the following functions or services:

  Ensure the secure and efficient operation of products and services: We may set Cookies or anonymous identifiers for authentication and security purposes to verify whether you have logged into the Services securely, or whether your account has encountered identity theft, fraud or other illegal activities. These technologies also help us improve service efficiency and speed up login and response times.

  Deliver a more convenient browsing experience: Such technologies can help you skip repeated steps of filling in personal information and entering search content (e.g., saving search records and form inputs).

  We may use Cookies to log browsing activities for troubleshooting crashes, delays and other anomalies, as well as exploring better service solutions.

If you use the web version of StardustTV, most browsers offer features to clear cached data. You can delete Cookie data in your browser settings, but doing so may disable certain functions or services we provide that rely on Cookies.

1.3 Information from Other Sources

We may receive the information described in this Privacy Policy from other sources such as:

Third-party Account information.  You can register to use our Services with third-party social network account details (Facebook, Tik Tok or Google) and your Apple account. If you log in to StardustTV with a third-party account, we will obtain your account information from such platform, including your nickname, Apple ID (iOS devices only) , profile picture, phone number or email address and other information you authorize, so as to create or log in StardustTV account, provide services enjoyed by log-in users, protect your account and prevent security risks.

Information received from others.  We may receive information about you from others, including where you are included or mentioned in direct messages, a complaint, appeal, request or feedback submitted to us, or if your contact information is provided to us.

1.4 Sensitive Personal Information Processing

Some of the personal information we process may constitute sensitive personal information under applicable laws, such as information related to children (if any) or payment/purchase information. We will only process sensitive personal information where: (1) We have obtained your separate, explicit consent (where required by law); (2) The processing is necessary for the performance of a contract with you; (3) The processing is required by applicable laws and regulations.We will not process sensitive personal information for purposes other than those explicitly stated in this Privacy Policy without your prior consent.

SPECIAL NOTE: Pursuant to applicable laws and regulations, information that cannot identify a specific individual either alone or in combination with other information does not constitute personal information. StardustTV may contain third-party SDK or other similar applications. If you use such third-party services, you consent to their direct collection and processing of your information (including through embedded code or widgets). The collection and processing of information by such third parties shall be governed by their own privacy policies, rather than this Privacy Policy. We will use reasonable efforts to review the access qualifications of such third parties and impose requirements to ensure their legality, compliance, and security.To protect your information security to the fullest extent, we strongly encourage you to carefully review their privacy policies before using any third-party SDK. Purpose of Processing : Ad attribution analysis to identify the source of application installations; deep link attribution to facilitate seamless navigation to specific in-app content; and install source performance analysis to optimize our marketing campaign allocation and effectiveness.

Personal Information Processed : Device identifiers (including Google Advertising ID (GAID), Apple Identifier for Advertisers (IDFA), and unique AppsFlyer device ID); application installation and activation event data; ad attribution parameters; deep link routing parameters; approximate location information derived from IP address; and user agent (UA) string indicating your device and browser characteristics.

2.3 For Legal Reasons

III. How We Store Your Personal Information

Presently, our server for storing your personal information related to StardustTV is located in the United States of America ("America"). You understand and agree that, under the conditions and terms of this Privacy Policy, we may transmit and store your personal information to/in such server upon compliance with applicable laws and regulations. Though the standard for the protection of personal information may vary in the location of our server and the judicial jurisdiction area of your place, we will do our best to protect your personal information with stricter standards and make the biggest effort possible to prevent the disclosure of your information.

As stated in this Privacy Policy, we may share your personal information with third parties, who may be located outside America. We will not transmit your personal information until we have complied with the applicable laws and regulations regarding cross-border transmission.

Access profile information.  You may access your personal information including your UID, nickname, profile photo by clicking “Profile” in the application/profile photo - “Account Center” in the website.

Usage information.  You may access part of your usage information at any time through the related product page, including the content you save to “My List” (by clicking “My List”) or your device (by clicking "profile" - "offline download"), watch history (by clicking “My List” or "profile" - “History”), transaction history, rewarded coin records and consumption records (by clicking “Profile” - “My Wallet”).

The right to copy your personal information.  On the Profile page, you may also copy your UID.

The right to delete your personal information.

Delete usage information.  You may delete part of your usage information at any time through the related product page. For example, you may delete your browsing records by clicking “My List” or "profile" - “History”.

Delete account.  You may remove any content from your account by deleting your account through the built-in online account deletion function. You may delete your account by clicking “Profile” - “Settings” – “Deletion Account”.

Clear Cache. You may delete information stored in the cache by clicking “Profile” - “Settings” – “Clear Cache”.

The right to withdraw your consent.  You may revoke any permissions you have granted to us, such as permission to access the camera, by changing the settings on your device.

VI. International Transfers

In order to provide you with the Services, we shall process your personal information in compliance with the applicable data protection laws and regulations of your jurisdiction.

Information sharing as described in this Privacy Policy may involve the transfer of your personal information to our affiliated entities or other third parties located outside your jurisdiction, for the purposes set out herein. Such jurisdictions may maintain privacy and data protection laws that differ from, and in certain circumstances may provide a lower level of protection than, those in the region where you reside.

We will implement appropriate safeguards to protect your personal information in accordance with this Privacy Policy and applicable laws and regulations.

VII. Privacy Policy Updates

We reserve the right to update or amend this Privacy Policy periodically in response to developments in applicable laws, technological advancements or business operations. When we revise this Privacy Policy, we will post the updated version and update the “Last Updated” date at the top of this policy.

We will also take reasonable measures to notify you in advance of material changes that may impact your privacy rights through one or more appropriate channels, including but not limited to official announcements, push notifications, in-app prompts or email notifications.

Where required by applicable data protection laws, we will obtain your prior consent to such changes before the revised Privacy Policy takes effect with respect to you. We recommend that you review this Privacy Policy each time you use the Services to remain informed of the latest version.

VIII. Language

This Privacy Policy is written in English and may be translated into other languages. In the event of any inconsistency, conflict or ambiguity between the English version and translated versions of this Privacy Policy, the English version shall prevail.

IX. Governing Law and Dispute Resolution

This Privacy Policy is governed by the laws of Hong Kong, except that for users residing in jurisdictions where local data protection laws mandate application of local law to personal data processing activities related to such users, the applicable local law shall prevail.

Any disputes arising hereunder will also be resolved in accordance with the Terms of Service.

X. Children's Privacy

Our application is not intended for minors who have not reached the age of majority for consent to personal data processing under the laws of their jurisdiction. Specifically: if we become aware that we have inadvertently collected personal information from a child under 13, we will take reasonable steps to delete that information promptly. If you are a parent or guardian and believe that your child under 13 has provided personal information to us, please contact us so that we can take steps to delete such information. We encourage parents and guardians to supervise your children's use of the Internet and help enforce our children's privacy policy by instructing your children never to provide personal information through StardustTV without your permission.

XI. Supplemental Terms – Jurisdiction - Specific

In the event of a conflict between the provisions of the Supplemental Terms – Jurisdiction-Specific applicable to your jurisdiction from which you access or use the Services, and the rest of the Privacy Policy, the relevant jurisdictions’ Supplemental Terms – Jurisdiction-Specific shall prevail.

11.1 United States of America (California - CCPA/CPRA)

11.1.1 Categories of Information Collected

In the past 12 months, we have collected identifiers (e.g., IP address, Email adress, UID), commercial information (e.g., purchase/payment history), and internet/electronic activity (e.g., watch history).

11.1.2 "Shine the Light" Law

We do not share your personal information with third parties for their own direct marketing purposes without your consent.

11.1.3 Your California rights

Depending on your residency, you have the following rights with respect to your personal information:

The right to know.  You have the right to request to know what personal information about you we have collected, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected.

The right to delete.  You have the right to request us to delete your personal information, subject to certain exceptions.

The right to correct. You have the right to request us to correct inaccurate personal information that we maintain about you. Note that correction requests are subject to certain limitations, and we may choose to delete rather than correct your personal information in some circumstances, for example, existing technologies are unable to achieve this.

The right to opt-out.  You have the right to opt-out of the sale or sharing of your information under CCPA. However, as aforesaid, we do not sell or share your personal information in the context of CCPA. Therefore, we do not have an opt-out. We will not sell or share your personal information without providing you with notice and an opportunity to opt-out of such sales and sharing.

The right to limit.  Under the CCPA, you have the right to limit our use and disclosure of your sensitive personal information. However, since we currently use sensitive personal information only for the necessary purposes permitted under the CCPA, such as providing the services you request, we do not have any use cases beyond this scope at this time. The right to non-discrimination.  We will not discriminate against you for your exercise of privacy rights conferred by the CCPA.

11.1.4 How you exercise your rights

Method.  You may exercise your rights by using methods described in the “What Are Your Rights and Choices” section. You may only make a verifiable consumer request for your “right to know” TWICE   within a 12-month period .

Verifying your request.  We only respond to your requests when we can verify your request. In order to verify your request, we may need additional information. If we cannot verify your identity, we will let you know.

Range of our response.  Any disclosures we provide will only cover the 12-month period preceding the verifiable user request’s receipt. If we cannot comply with any portion of a request, the response we provide will also explain the reason, if applicable.

Authorized agent.  If you choose to use an authorized agent to submit your request, we may require your agent to provide proof that you have given signed permission to submit the request. We may also require that you: (1) provide the authorized agent written permission to do so; and (2) verify your own identity directly with us. We will not require these steps if we have received proof that you have provided the authorized agent with a power of attorney pursuant to California Probate Code sections 4121 to 4130. We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf or from an agent that does not meet the requirements for authorized agents under the CCPA.

Fees and charges.  We do not ordinarily charge a fee for our response to your requests. However, where a request is excessive, repetitive, or manifestly unfounded, we may determine to charge a reasonable fee to comply with your request.

Response timing.  We will use good faith efforts to respond to your request within 45 days of receipt of such a request. Where an extension (up to a total of 90 days) is necessary, we will inform you of the reason and the needed extension period in writing. We will comply with your request to limit within 15 business days from the date of our receipt of your request.

11.1.5 Financial Incentive Program

We may offer you a Financial Incentive Program related to the collection, retention, or use of your personal information. These incentives are designed to reward user participation or engagement, such as when you complete certain tasks, participate in activities, or use our services. We may grant you virtual currency, points, coupons, discounts, or other similar benefits (collectively, "Rewards").

Participation in such programs is entirely voluntary. You may choose to join or opt out of the program at any time without any discrimination.

The categories of personal information that may be involved in these financial incentives include identifiers (such as email address, user ID); commercial information (such as transaction history, points history); and information related to your interactions (such as task completion, usage frequency, or preferences).

The personal information we collect is used solely to provide, operate, and improve the Services and will not be used beyond the scope described in this Privacy Policy.

11.2 Additional Notice for Residents of European Economic Area ("EEA"),the United Kingdom and Switzerland

This section applies to residents of the European Economic Area ("EEA"), the United Kingdom ("UK") and Switzerland and supplements our general Privacy Policy. In the event of any conflict between this section and other parts of this Privacy Policy, the provisions of this section shall prevail.

11.2.1 Your Rights under the GDPR/UK GDPR/Swiss FADP

Your rights regarding your personal information in accordance with GDPR, UK GDPR and Swiss FADP specifically include the following:

The right of access.  You have the right to request access to your personal information, which enables you to receive a copy of information undergoing processing.

The right to rectification.  You may request correction of inaccurate personal information without undue delay. You may also supplement any incomplete personal information, taking into account the purposes of the processing.

The right to withdraw consent.  Where your personal information is processed based on consent, you have the right to withdraw your consent at any time. The withdrawal of your consent does not affect the legitimacy of the processing that occurred based on your consent until the withdrawal.

The right to erasure (right to be forgotten).  You have the right to request erasure of your personal information under the following circumstances: (1) the personal information is no longer necessary for the purposes of processing, (2) you withdraw your consent if the processing is solely based on consent, (3) you object to the processing and we have no overriding legitimate grounds or you object to the processing for direct marketing purposes, (4) your personal information has been unlawfully processed or (5) there is a legal obligation imposed on us to erase your personal information. However, where your personal information is necessary for specific purposes set forth in GDPR, the right to erasure (right to be forgotten) shall not apply.

The right to restriction.  You have the right to restrict the processing of your personal information if (1) the accuracy of your personal information is contested by you, for the period in which we have to verify the accuracy of the personal information, (2) the processing is unlawful, and you oppose the deletion of your personal information and request restriction, (3) we no longer need your personal information for the purposes of processing, but your personal information is required by you for legal claims, (4) you have objected to the processing for the period in which we have to verify overriding legitimate grounds.

The right to portability.  You have the right to portability, where (1) the processing of your personal information is based on a legal basis of contractual necessity or consent, and (2) the processing is carried out by automated means. This means that you have the right to receive your personal information you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit that information to another controller without hindrance from us.

The right to object.  You have the right to object to the processing of your personal information at any time. We will comply with your request, unless we have an overriding legitimate ground or we need to continue processing your personal information to establish, exercise, or defend a legal claim. Where you object to the processing of your personal information for direct marketing purposes, which includes profiling to the extent that it is related to such direct marketing, we will no longer process your personal information for these purposes.

The right to lodge a complaint with a supervisory authority.  You have the right to lodge a complaint about our processing of your personal information with your national data protection authority.

You may contact us via the contact information provided herein, if you wish to exercise all the above-mentioned rights or if you have any problems related to those rights. You will not usually have to pay a fee to exercise your rights. However, where your request requests are manifestly unfounded, repetitive, or excessive, we may charge a reasonable fee. We may need to request specific information from you to help us confirm your identity and ensure your rights. Where a third party submits a request on your behalf, we may need to take reasonable measures to verify the authenticity of the request. In order to speed up our response, we may ask for further information in relation to your request.

11.2.2 International Transfer

We may transfer your personal information outside the European Economic Area (EEA), the United Kingdom, and Switzerland for the purposes described in this Privacy Policy. For example, we may transfer your personal information to our headquarters in Hong Kong or to other countries or regions where our service providers or partners are located, only under the circumstance of these processing actions permitted by applicable laws. When transferring personal information from the EEA, the United Kingdom, or Switzerland to jurisdictions outside these regions, we implement appropriate safeguards to ensure that your personal information receives a level of protection equivalent to that provided within the EEA, the United Kingdom, or Switzerland.

11.2.3 Response timing

11.3 Southeast Asia (Indonesia, Thailand, Philippines, Singapore)

11.3.1 Thailand (PDPA)

We will only process sensitive data (if any) with your explicit consent unless permitted by the Personal Data Protection Act.

We will use good faith efforts to respond to your request within 30 days of receipt of such a request.  

11.3.2 Philippines (DPA)

We acknowledge your rights as a data subject under the Data Privacy Act of 2012, including the right to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal data.

We will use good faith efforts to respond to your request within 15 days of receipt of such a request.  

11.3.3 Singapore (PDPA)  

We will notify you of the purposes for which we collect, use, or disclose your personal data and obtain your consent, unless an exception under the Personal Data Protection Act applies.

We will use good faith efforts to respond to your request within 30 days of receipt of such a request.  

11.3.4 Indonesia (Law No.27/2022)

We will use good faith efforts to respond to your request within 15 days of receipt of such a request.

11.4 East Asia (Japan, South Korea)

11.4.1 Japan (APPI)

We comply with the Act on the Protection of Personal Information. If we provide personal data to a third party outside of Japan, we will ensure they maintain a system that conforms to the standards prescribed by the Enforcement Rules of the APPI.

11.4.2 South Korea (PIPA)

When we destroy personal information because the retention period has expired or the purpose of processing has been achieved, we do so in a manner that makes it unrecoverable.

11.5 Brazil (LGPD)

Overseas Disclosure : While we take steps to ensure that overseas recipients (including our servers in America) handle your data in accordance with the Australian Privacy Principles, you acknowledge that we may not be able to ensure their compliance with Australian law in all circumstances.

Complaints : If you are dissatisfied with our response to a privacy complaint, you may contact our Data Protection Officer (DPO) at stardusttvapp@gmail.com  or the Office of the Australian Information Commissioner (OAIC).

11.7.2 Turkey (KVKK)

We process your data in accordance with the Law on the Protection of Personal Data (KVKK) No. 6698. You have the right to request information regarding whether your personal data is transferred to third parties in Turkey or abroad.

11.7.3 Canada (PIPEDA)

Personal information may be stored outside of Canada and may be subject to the laws of the jurisdiction in which it is stored, including access by foreign courts or law enforcement.
